orengeo™ Transaction Service

 

This service agreement defines how the orengeo™ auction site (the "Site") will handle transaction services, including receiving and transferring payments, on behalf of buyers and sellers. Any seller listing item(s) at the Site and any buyer bidding on item(s) or purchasing item(s) via Express Buy hereby explicitly agrees to the use of the orengeo™ Transaction Service (the "Transaction Service") provided by the Site and any terms and conditions specified in this agreement. If you as a buyer or a seller do not agree to the terms and conditions in this service agreement or the use of the Transaction Service, then you are asked to terminate the use of the Site and its services immediately.

The Site does not charge any fee for the Transaction Service to either the buyer or the seller. However, the Site does request to the buyer and the seller to follow guidelines (Buyer & Seller Responsibilities) specified in this agreement.

What is Transaction Services?

The Transaction Service has been designed to protect both the buyer and the seller by eliminating potential fraud by acting as an independent party that

  • Receives payment(s) from the buyer
  • Distribute the payment(s), less any fees, to the seller once the transaction is completed successfully

By utilizing the Transaction Service, the buyer can feel safe by knowing that his/her money is not paid immediately to the seller until the item is received and the buyer has an opportunity to review the purchased item(s) before the money is released to the seller. Also, the seller can be assured that the payment for the item has received and confirmed prior to shipping the item to the buyer.

Following sections will provide additional information.

Buyer Responsibilities

As a part of the Transaction Service, you will be sent courtesy email messages explaining what you (as a buyer) must do to complete the transaction successfully. The overall processes related to you are as follow:

  • You are first required to make payment within seven (7) calendar days (the "Payment Period") once you win a bid or purchase an item directly through Express Buy.
  • • Once the payment is submitted and accepted, you acknowledge that the seller has up to seven (7) calendar days (the "Shipping Period") to ship the item. In the meantime, your payment will be released to your account subject to withdrawal provisions based on the history of your account
  • You have a right to contact the seller for requesting the item to be sent or to raise an issue (case) with the seller if the item is not shipped even after the Shipping Period expires.
  • Once the seller ships the item and notifies the Transaction Service, the Transaction Service will notify you immediately with the item shipping message.

  • If you are not satisfied with the item, however, you can contact the seller to arrange for returning the item for refund or raise an issue (case) with the seller. When you do raise an issue (case), please be specific about why you are raising an issue (case). Please review the Case or Dispute Resolution section for more information.

Seller Responsibilities

  • After an item is sold via either an auction process or Express Buy, you acknowledge that the buyer has seven (7) calendar days (the "Payment Period") to pay for the item.
  • You have a right to contact the buyer for requesting the payment or to raise an issue (case) with the buyer if the payment is not made even after the Payment Period expires.
  • Once the Transaction Service informs you that the payment for the item has been received and confirmed along with the shipping related information, you are required to send the item to the buyer within seven (7) calendar days (the "Shipping Period").
  • If you are not satisfied with the buyer's performance, you can contact the buyer to perform to fulfill the transaction or raise an issue (case) with the buyer. When you do raise an issue (case), please be specific about why you are raising an issue (case). Please review the Case or Dispute Resolution section for more information.

Case or Dispute Resolution

As a user of the Site, you are entitled to file a dispute with the Site if you are unhappy with either any item listed and sold by the Site or any service the Site provides. When you do file a dispute, the Site requests that you provide a detailed description of the “problem”. The Site will do its best to resolve any dispute as fair and quickly as possible. When an issue (case) is raised during a transaction with another member, however, you are entitled to bring up the issue (case) with the other party. When you do raise an issue (case), however, you are waiving your right to complete the transaction through a "normal" transaction processing. Instead, you are explicitly agreeing to accept the following steps to resolve the issue (case):

  • The transaction in question will be taken out from the "normal" transaction processing and placed as "RESOLUTION CASE" status.
  • Any payment made by the buyer will remain unpaid to the seller and be held by the Transaction Service until a final agreement/resolution is achieved by the buyer and the seller.
  • Both the buyer and the seller agree to communicate voluntarily and diligently to achieve a mutually acceptable agreement/resolution and to inform the Transaction Service of such agreement/resolution.

It is possible that even the best intention by the buyer or the seller cannot resolve the issue (case). In such case, a dispute can be filed by either the buyer or the seller at any time. Unlike the issue (case) opened previously, when a dispute is filed a third party arbitrator will get involved and mediate between the buyer and the seller. As a part of using the Transaction Service, both the buyer and the seller must agree to A) the use of the third party arbitrator, B) assist the arbitrator in resolving the dispute, and C) accept the arbitrator's decision as the final agreement/resolution.

The maximum resolution period - from the day an issue (case) is raised to the day an agreement/ resolution is reached with or without an arbitrator - shall not exceed thirty (30) calendar days, unless otherwise agreed by both the seller and the buyer. As indicated previously, during the resolution period, any payment made by the buyer will remain unpaid to the seller and be held by the Transaction Service until a final agreement/resolution is achieved.
